Texas non-subscriber or employment litigation experience is a plus.
Ability Independently manage a large caseload from claim inception to completion.
Pre-litigation investigation.
Written discovery, depositions, expert discovery, and motions/hearings/and trial.
Case valuation and analysis and written case evaluation reports.
Job Summary The Assistant General Counsel is responsible for assisting the General Counsel in the management and handling of all legal related matters for the Company.
This position is in Carrollton, TX at the corporate headquarters for Cantex Continuing Care Network.
The attorney will manage healthcare litigation matters and generally assist the Company in all other legal related matters, including employment matters, facility license renewal, contract negotiation, and regulatory and compliance matters.
Ideally this candidate will have experience in healthcare litigation, specifically in the long term care industry.
Qualifications Juris Doctor (JD) from accredited law school and a member in good standing with the bar of the State of Texas.
3 to 5 years law firm or in-house experience.
Experience practicing law in the health care field is strongly preferred.
Ability to independently manage litigated healthcare liability claims from inception to conclusion.
Experience drafting and arguing motions and briefs, taking and defending depositions, engaging and coordinating with expert witnesses, and preparing for and taking part in jury trials.
Must be willing to learn health areas of law impacting health systems and how to practice law in an in-house setting.
Provide legal counsel to management on compliance with healthcare regulations and compliance issues.
Ability to work independently and in a team orientated fast-paced environment.
Detail oriented with exceptional analytical and organizational skills, including the ability to manage diverse assignments and projects, exercising sound judgment and decision making and prioritization of multiple deadlines.
Strong professional ethical principles.
Proficient communication skills both verbal and written.
Ability to anticipate and prevent legal issues and risks.
Ability to work in a fast pace environment.
Ability to understand and resolve complex legal and business issues.
Ability to travel within the state of Texas - 10-20% Essential Functions Provides in-house legal counsel on healthcare liability related matters, which may include, but not limited to, healthcare liability litigation, grievances and arbitrations.
Ensures compliance with all applicable laws, regulations and policies.
Independently manage healthcare liability claims before federal and state courts, arbitration panels, and state and federal regulatory and administrative agencies.
Conduct and manage internal investigations relating to open claims and matters across the business.
Prepares and reviews contracts and other corporate documents.
Identifies and assesses legal risks and opportunities within the business and advises accordingly.
Independently handles legal matters and projects ranging from basic to complex.
Provide legal advice in all areas affecting the company by identifying and analyzing legal issues, drafting legal documents, presenting clear recommendations, and ensuring legal compliance with regulatory requirements.
Provide counsel and advice to management on pending disputes, claims, and litigation.
Advising on contract status, legal risks, and the legal liabilities associated with different agreements.
Researching and anticipating unique legal issues that could impact the company.
